Not every Windows 10 upgrade goes well, and Microsoft has been sued before for ones which went wrong and which then caused loss of time, data and productivity.

Noone, however, has been so bold as to claim their time and money was worth $6 billion (or even $600 million), that is until Mr Frank Dickman came along.

Dickman, from New Mexico, is suing Microsoft in general and Satya Nadella in particular after his Asus 54L notebook failed to upgrade properly to Windows 10 from Windows 7.

He spoke to Microsoft support, who referred him to Asus, who Mr Dickman found “untrustworthy.”

He and his solicitor are currently giving Microsoft either 30 days to deliver a “quality” downloadable version of Windows 7 which will work with his device key, or pay him “$6,000,000,000.00 ( $600m).

The only sensible remedy is for Microsoft Corporation to supply the OEM version of its operating system by download from its website and confirmed by the key code which came with the computer,” he demanded.

Microsoft has apparently declined to comment on the case.
